A Shape Mark is a type of trademark that protects the three-dimensional (3D) shape of a product or its packaging, provided the shape is distinctive and helps consumers identify the source of the goods.

Instead of a word, logo, or slogan, a shape mark relies on the visual appearance of the product itself as an indicator of origin.

Shape marks are recognized under the Trade Marks Act, 1999 (India) and internationally under the TRIPS Agreement and the Paris Convention.

Legal Position in India

  • Governed by Section 2(1)(zb) and Section 9 of the Trade Marks Act, 1999.

  • Not Registrable if:

    1. The shape results from the nature of the goods themselves.

      • Example: A round ball shape for football.

    2. The shape is necessary to obtain a technical result.

      • Example: LEGO brick shapes were denied protection because they were functional.

    3. The shape gives substantial value to the goods.

      • Example: A shape that is purely ornamental or aesthetic and adds value rather than brand recognition.

    • Multiple views (front, side, top, perspective) are often required.

  3. Examination by Registrar – To check distinctiveness and functionality.

  4. Objection (if any) – Respond to objections if Registrar considers it functional/common.

  5. Publication in Trademark Journal – Open to opposition by third parties.

  6. Opposition Proceedings – If someone opposes, both sides present evidence.

  7. Registration – If no opposition, or if decided in favor of the applicant, registration is granted.


Challenges with Shape Marks

  • Functionality Bar – Functional shapes cannot be protected.

  • High Burden of Proof – Must prove that the shape has acquired distinctiveness through extensive use.

  • Consumer Perception – Courts often ask: “Do consumers identify this shape with the brand, or just the product itself?”
