Issues Related to Section 66A of the IT Act, 2000

Section 66A of the Information Technology Act, 2000 was one of the most controversial provisions in Indian cyber law. It criminalized sending “offensive, menacing, or false messages” via electronic communication, including social media, email, and messaging platforms. However, the section faced severe criticism for curbing free speech and was eventually struck down by the Supreme Court in 2015 in the landmark case Shreya Singhal v. Union of India.


Key Provisions of Section 66A (Before Being Struck Down)

Section 66A stated that anyone who sends information via a computer or communication device that is:

  1. Grossly offensive or menacing,

  2. False and causes annoyance, inconvenience, danger, obstruction, insult, injury, criminal intimidation, or enmity,

  3. Information sent to deceive or mislead the recipient

could be punished with imprisonment for up to three years and a fine.


Issues Related to Section 66A

1. Vague and Ambiguous Language

  • Terms like “grossly offensive,” “annoyance,” “inconvenience,” and “menacing” were undefined, leaving them open to subjective interpretation.

  • This ambiguity allowed arbitrary use by authorities, leading to potential misuse.

  • Critics argued that Section 66A violated Article 19(1)(a) of the Indian Constitution, which guarantees the right to freedom of speech and expression.

  • Numerous cases showed the law being used to intimidate citizens for expressing opinions online.

  • Social media users, bloggers, journalists, and activists were often arrested for innocuous posts, including political opinions or satire.

  • Section 66A did not require mens rea (criminal intent) for prosecution, meaning even unintentional or harmless communications could attract penalties.

  • There were no clear guidelines for determining intent or harm, increasing the risk of abuse.

  • The threat of arrest under Section 66A created a chilling effect on free speech, discouraging citizens from engaging in public debate on social media.

Landmark Supreme Court Judgment

In Shreya Singhal v. Union of India (2015):

  • The Supreme Court struck down Section 66A as unconstitutional.

  • The Court ruled that the section violated Article 19(1)(a) because the restrictions imposed were not reasonable and disproportionately curtailed free speech.

  • The judgment reaffirmed that freedom of speech includes online expression, subject to reasonable restrictions for public order, defamation, and security.
