Golden Triangle Doctrine in Constitutional Law – Articles 14, 19 and 21

  • Before 1978, in A.K. Gopalan v. State of Madras (1950), the Supreme Court held that each fundamental right was independent and unrelated.

The doctrine means that no law affecting personal liberty can be valid unless it satisfies the tests of all three Articles:

  1. Article 14 – Right to Equality

    • If a law restricts liberty, it must also respect freedoms like speech, movement, and profession.

  3. Article 21 – Right to Life and Personal Liberty

  • Passport of Maneka Gandhi was impounded without giving reasons.

  • The Court held that procedure under Article 21 must be fair, just, and reasonable, and laws must also satisfy Articles 14 and 19.

2. Kesavananda Bharati v. State of Kerala (1973)

  • Although primarily about the Basic Structure Doctrine, the Court hinted that liberty, equality, and freedoms form the core of the Constitution.

3. Subsequent Cases

  • Francis Coralie Mullin v. Union Territory of Delhi (1981): Expanded Article 21 to include the right to live with dignity.

  • Justice K.S. Puttaswamy v. Union of India (2017): Recognized the right to privacy as part of Article 21, relying on the golden triangle interpretation.
