Complete Steps of Trademark Registration in India

In India, the process of trademark registration is governed by the Trade Marks Act, 1999. The registration involves several stages, starting from filing the application to examination, publication, opposition, and final registration.

Step 1: Filing of Application

  • The process begins with filing Form TM-A before the Registrar of Trademarks.

  • The application must contain details such as:

    • Name and address of the applicant.

    • Trademark representation (logo, word, device, or symbol).

    • Class of goods/services.

    • Date of first use (if applicable).

  • Once filed, the applicant receives an acknowledgment number for tracking.


Step 2: Examination by Registrar

  • The Registrar of Trademarks reviews the application to ensure it complies with the law.

  • If no issues are found, the application moves forward.

  • If the Registrar finds any defects, an examination report is issued marking objections (e.g., lack of distinctiveness or similarity with an existing mark).

  • The applicant must respond to these objections within the given timeframe.


Step 3: Publication in the Trademark Journal

  • If the Registrar accepts the application (either directly or after objections are cleared), it is published in the Trademark Journal.

  • Publication makes the application available in the public domain so that third parties can review it.


Step 4: Opposition by Third Parties

  • After publication, any person who believes the trademark is identical or confusingly similar to their own mark may file an opposition within 4 months.

  • Opposition is filed through a Notice of Opposition.


Step 5: Counter-Statement by Applicant

  • If an opposition is filed, the applicant must submit a counter-statement within 2 months.

  • Failure to respond results in abandonment of the application.


Step 6: Evidence Filing

  • Evidence by Opponent: The opponent files evidence supporting the opposition.

  • Evidence by Applicant: The applicant files evidence supporting their right to registration.


Step 7: Hearing and Order by Registrar

  • The Registrar schedules a hearing where both parties argue their case.

  • After considering the evidence and arguments, the Registrar issues an order either:

    • Allowing the trademark to proceed to registration, or

    • Upholding the opposition and rejecting the application.
